Employer Alert: Continue to Use Current Form I-9 after October 31, 2022

Updated: Jan 24, 2023

The I-9 will remain valid beyond 10/31/2022! There is no new date of expiration set at this point.

What does this mean?

Employers should continue to use the current version of the I-9 form.

The expiration date of the I-9 is listed at the top right-hand corner of the I-9 and many employers were gearing for form changes, but we will not have a new form by 11/1/2022. When the updated version of Form I-9 is ready to be distributed, the Department of Homeland Security (DHS) will notify the public by placing an announcement in the Federal Register. We will keep our CICI subscribers in the know!

Why Should You Care?

Employers are responsible for corporate immigration compliance, including always using the latest version of the I-9. As a reminder, The Immigration Reform and Control Act (IRCA) of 1986 mandates that all companies in the United States have a completed I-9 for all employees hired on or after November 6, 1986.

Let’s talk about I-9 Administrator Training from CICI:

We encourage anyone who touches I-9s for your company take our hands-on live I-9 Administrator webinar training with our attorney instructors.
